Terms of Service & Membership Agreement

1. The Agreement
This Agreement is entered into between Aloha Table Tennis Association(“ATTA”, “we”, “us”), a 501(c)(3) nonprofit organization, and you (the “Member” or “you”), for the purpose of providing access to the ATTA facility located at 1375 Dillingham Blvd. #204, Honolulu, HI 96817 (the “Facility”) and to this website and member platform (the “Platform”).
It covers memberships, drop-in visits, guest bookings, use of the Facility, and use of the Platform. Please read it carefully, especially Section 9 (Assumption of Risk & Liability Waiver) and Section 15 (Dispute Resolution), which affect your legal rights. If you do not agree to be bound by these Terms in their entirety, you may not access or use the Facility or the Platform.
2. Accepting These Terms
You accept these Terms when you do any of the following:
- create an ATTA account on this site;
- purchase a membership, drop-in visit, or multi-visit pack;
- enter or use the Facility.
Electronic acceptance
Checking the acceptance box and submitting the form is your electronic signature. It has the same legal effect as signing ATTA's paper membership agreement in person, and you consent to transact with us electronically. Because Section 9 affects your legal rights, the liability waiver is named in the acceptance itself rather than buried in a reference: wherever you tick a box to accept these Terms, that box says it covers the waiver. We record the date and time of each acceptance and the version of these Terms you accepted. This Agreement supersedes any earlier paper agreement you signed with ATTA.
Which version applies
The version of these Terms you most recently accepted governs your agreement with us. When we make a material change, we will ask you to accept the updated Terms, and the updated version governs from the date you accept it. See Section 14.
Accepting on someone else's behalf
If you enroll a minor in your care, you must be the minor's parent or legal guardian, and you accept these Terms, including Section 9, on the minor's behalf as well as your own. See Section 3.
If you book a drop-in visit for a guest, you accept these Terms, including Section 9, on that guest's behalf. By doing so you confirm that you have their permission to book and pay for them and that you have made them aware of these Terms, and you remain responsible for your guest as described in Section 6. ATTA may still ask a guest to accept these Terms for themselves before they play.
3. Eligibility, Minors & Referrals
Age
You must be 18 or older to create an account or purchase a membership. Players under 18 are welcome at the Facility, but must be enrolled by a parent or legal guardian through the guardian's own account. The guardian accepts these Terms, including the waiver in Section 9, on the minor's behalf. ATTA may require additional supervision for minors, and may require the guardian to sign a separate minor release covering assumption of risk, consent to emergency medical care, and an emergency contact for the minor.
Referral
New members may be asked to provide a referral from a current member in good standing, or from a former member who left in good standing, before being approved for membership. Any referral requirement is applied uniformly and without regard to race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, or any other characteristic protected by law. The referral program is discretionary and may be changed or discontinued at any time.
4. Your Account
- Provide accurate information when you sign up, including a working email address and a phone number, and keep it current. We use it to reach you about your membership and your visits.
- Keep an emergency contact name and phone number on file with the club, and keep it current. We use it to reach someone you trust if you are injured at the Facility. See Section 9.
- Keep your login credentials confidential. You are responsible for activity under your account. Tell us promptly if you believe it has been used without your permission.
- Accounts and memberships are personal to you. Do not share, transfer, or resell your account, your membership, or any visit or pass you purchase.
- Do not attempt to disrupt, probe, scrape, or gain unauthorized access to the Platform or to other members' information.
- We provide the Platform on an as-available basis. Scheduled maintenance, outages, and errors happen. If the Platform is unavailable, contact the club directly using the details in Section 17 and we will handle access and bookings manually.
5. Membership & Billing
What membership gives you
ATTA grants you access to the Facility according to the membership tier you have purchased. Benefits, rates, and tier names are those published on this site and in your account at the time of purchase, and may be updated from time to time.
Recurring payments
Your membership is billed monthly in advance to the payment method you provide, and it renews automaticallyeach month until you cancel. You can cancel at any time from your dashboard, under "Manage billing", or by contacting us. Cancelling stops future renewals.
- Payments are processed by Stripe. ATTA does not store your full card number. Your use of Stripe's checkout is also subject to Stripe's own terms.
- If a payment fails, we will attempt to notify you and may allow a short grace period during which your access continues while you update your payment method. If the balance remains unpaid after the grace period, access may be suspended or the membership cancelled.
- We may change membership rates with at least 30 days' notice to the email address on your account. The notice will state the new rate, when it takes effect, and how to cancel if you do not want to continue. Continuing your membership after the change takes effect is acceptance of the new rate.
Your five-day cancellation right
You may cancel a new membership, for any reason, within five (5) business days(excluding weekends and holidays) after the day you first purchase it. Cancel from your dashboard under "Manage billing", by email to contact@alohatabletennis.org, or by written notice delivered to the club. If you cancel within this window, we will refund everything you paid for the membership within 30 days, less the published drop-in value of any visits you actually made. This window applies to your initial purchase, not to monthly renewals.
Cancellation and refunds
- You may cancel at any time from your dashboard, under "Manage billing", or by contacting us. Cancellation stops future renewals.
- After the five-day window, cancellation takes effect at the end of the billing period you have already paid for; your access continues until then. We do not prorate or refund partial months, except where these Terms provide otherwise, where required by law, or at ATTA's discretion.
- If ATTA terminates your membership without cause (see Section 13), we will refund the unused portion of any period you have already paid for, calculated pro rata.
- Drop-in visits, coaching sessions and multi-visit packs are non-refundable and non-transferable once purchased. An unused booking can be moved, and you may ask us to cancel one, as described in Section 6. Packs expire on the date shown at purchase, if any.
Chargebacks
If you dispute a charge with your bank rather than contacting us first, ATTA may suspend your access while the dispute is resolved. Please talk to us. Most billing problems are quicker to fix directly.
6. Bookings: Drop-Ins, Coaching & Guests
Drop-in visits
- A drop-in visit admits one person for up to two (2) hours of open play. Continued play beyond two hours requires an additional paid visit, subject to table availability.
- Visits are booked for a specific date, are subject to table availability, and do not reserve a particular table or time slot. A visit is used once it is checked in against your booking.
- If you do not check in on your booked date, the visit is not lost. Contact the club and we will rebook it for another date, for up to twelve (12) months from the date of purchase, after which it expires. Visits are non-refundable.
- Drop-in rates differ between peak and non-peak hours, as published on this site.
- See Section 7 for how to get into the Facility. Have your confirmation code ready when you arrive or call.
Coaching sessions
- A coaching session is one hour with one ATTA coach, at that coach's own published rate. The rate is fixed when you book and does not change afterwards, including if the coach changes their rate later.
- You may pay by card through this site, or ask the coach for a session you pay for in cash. A cash session is a request until the coach accepts it. Nothing is charged and no session is confirmed until they do.
- Coaching is arranged between you and the coach. ATTA takes a share of the fee and keeps the record of the booking, but the session itself is the coach's to teach and yours to attend.
Changing or canceling a booking
- Moving it. Up to 24 hours before a booking starts, you can move it yourself from your dashboard. A drop-in moves to any open window; a coaching session moves to another hour the same coach has open. Moving does not change the coach, and it does not create a new booking. A drop-in with a free guest pass on it is the one exception: call the club and we will move it for you.
- What moving costs. Nothing, for coaching. For a drop-in, peak and non-peak rates differ, so a session moved into a dearer window leaves a difference payable at the desk before you play. We tell you the amount before the booking moves. Moving into a cheaper window does not entitle you to a refund of the difference.
- Canceling. Up to 24 hours before a booking starts, you can ask us to cancel it, with a reason. This is a request, not a cancellation: your booking stays live and you should still turn up until we answer. We answer from the club, and we will tell you either way.
- Refunds on a canceled booking. Bookings are non-refundable under Section 5, so a canceled booking does not automatically entitle you to your money back. Where we do refund one, we say so when we answer and the refund is made to the card you paid with, which can take several days to appear.
- Inside 24 hours. Call the club. We are not obliged to move or cancel a booking at short notice, and a coaching session in particular is an hour the coach has kept free for you, but we would rather hear from you than not.
Booking for a guest
Members may pay a guest drop-in rate for someone who does not have an ATTA account. If you do:
- You confirm you have that person's permission to book and pay on their behalf, and that you have made them aware of these Terms.
- You accept these Terms on their behalf, including the assumption of risk and liability waiver in Section 9, and you accept them for yourself as the person who brought them in.
- You are responsible for your guest's conduct in the Facility and for any damage they cause.
- If your guest is under 18, only their parent or legal guardian may accept on their behalf.
- ATTA may still ask a guest to accept these Terms themselves before they play, and may decline entry to a guest who will not.
7. Hours & Facility Access
The Facility is open to members from 6:00 a.m. to midnight, Hawaii Standard Time. No member may be in the Facility between midnight and 6:00 a.m. There is no after-hours access, and no membership includes it.
Getting in
There is no front desk, and the Facility may be unstaffed. The front door is a fingerprint lock. Members who have been enrolled at the door open it themselves; enrollment happens in person at the club, and you can book a time for it from your account dashboard.
If you have not been enrolled, or you are visiting on a drop-in or as a guest, call the club at (808) 841-8844 at least 30 minutes before you head over so we can confirm someone is available to let you in. If the doors are locked when you arrive, the lock can be released remotely.
Secure the Facility when you leave, and follow any instructions ATTA gives about lighting, noise, and equipment at the end of the day.
Closures
ATTA may close the Facility or restrict access for maintenance, private events, tournaments, holidays, weather, or emergencies. We will give notice where we reasonably can. Short closures do not entitle you to a refund or credit. If the Facility is fully closed to members for more than seven (7) consecutive days, we will credit the affected portion of your membership, calculated pro rata.
8. Rules & Code of Conduct
You agree to abide by ATTA's rules and regulations, which may be updated from time to time, and to follow all safety instructions given by ATTA staff. In particular:
- Use the Facility and equipment safely and responsibly, and report any damage or hazard to staff immediately. You are responsible for damage to the Facility or its equipment caused by your misuse or negligence, beyond normal wear and tear.
- Treat other players, staff, and guests with respect. Harassment, discrimination, intimidation, threats, and abusive language are not tolerated.
- Do not behave in a way that is disruptive, dangerous, or offensive to others.
- Wear appropriate athletic clothing and non-marking court shoes.
- No alcohol, illegal drugs, or use of the Facility while impaired. No smoking or vaping.
- Do not bring in outside coaches or run paid instruction, commercial activity, or organized events without ATTA's written permission.
- Do not let anyone else in through a door that was unlocked for you. Everyone entering must have their own membership or paid visit.
- Clean up after yourself and return equipment to its place.
ATTA staff may ask anyone to leave the Facility for breach of these rules.
9. Assumption of Risk & Liability Waiver
Please read this section carefully. It affects your legal rights. The acceptance you tick when you join says, in as many words, that it covers this section.
Disclosure of inherent risks
Table tennis and other physical activity at the Facility involve inherent risks: dangers that a reasonable person would understand to come with the activity by its very nature, that exist even when reasonable care is taken, and that are generally beyond ATTA's control. They include, but are not limited to: slips, trips, and falls; collisions with other players, tables, barriers, or equipment; strains, sprains, and fractures; being struck by a ball or paddle; overexertion and cardiac events; other injury or harm to you or your property; and, in rare cases, permanent disability or death. These risks cannot be eliminated regardless of the care taken.
Your condition and preparation
You confirm that you are in adequate physical condition to participate, that you have no medical condition that would make participation unsafe, and that you have consulted a physician if there is any doubt. You agree to ask ATTA if anything about the safe use of the Facility or its equipment is unclear, and you are responsible for stopping and seeking help if you feel unwell.
Assumption of risk and release
Having read the disclosure above, you voluntarily assume all inherent risks of your use of the Facility and its equipment. To the fullest extent permitted by Hawaii law, you release, waive, and hold harmless ATTA, its directors, officers, employees, volunteers, agents, and affiliates from any and all liability, claims, demands, damages, or causes of action for injuries or losses resulting from those inherent risks.
This release extends to claims of ordinary negligence only to the extent, if any, that a release of such claims is permitted by applicable law. Nothing in this section waives liability that cannot be waived by law, including any liability preserved by Hawaii Revised Statutes § 663-1.54 and liability for gross negligence, recklessness, or intentional misconduct.
ATTA's obligations
ATTA agrees to exercise reasonable care to ensure the safety of members and guests while they use the Facility, to maintain its facilities and equipment in good repair, to keep the premises clean and sanitary, and to make emergency contact information available to members in case of incidents or emergencies.
Your property
You are responsible for your own personal property. ATTA is not liable for property that is lost, stolen, or damaged at the Facility, including from lockers.
Limits on other damages
To the extent permitted by law, ATTA is not liable for indirect, incidental, or consequential damages arising out of the Platform, billing, or bookings, and ATTA's total liability for claims relating to the Platform, billing, or bookings will not exceed the amounts you paid ATTA in the twelve (12) months before the claim arose. This limit does not apply to claims for death or bodily injury, to gross negligence, recklessness, or intentional misconduct, or to any liability that cannot be limited by law.
Emergency contact and care
You agree to keep an emergency contact name and phone number on file with ATTA, and you authorize ATTA to contact that person and to arrange emergency medical care on your behalf if you are injured and unable to consent. For a minor, the guardian provides this authorization. You, or the minor's guardian, are responsible for the cost of that care.
Minors
A parent or legal guardian accepts the risks described in this section on the minor's behalf, to the extent permitted by law, and remains responsible for the minor's safe participation. ATTA may require the guardian to sign a separate minor release before the minor uses the Facility. See Section 3.
10. Photography & Security Cameras
Club media
We take photographs and video at the Facility and at events for ATTA's website, social media, fliers, banners, and other promotional use. Unless you opt out, you consent to ATTA's use of your photograph or likeness (still or motion) for these purposes, without compensation. If you would prefer not to appear, contact us at any time. We will make reasonable efforts to keep you out of new promotional media and will remove existing images on request.
Security cameras
You are aware of and consent to ATTA's use of security cameras within the Facility to monitor activity. The cameras record video only; they do not record audio. Camera coverage is for the safety and security of everyone at the Facility, is a condition of entry, and cannot be opted out of. Our Privacy Policy explains where footage is stored and how long it is kept.
11. Communications
By creating an account you agree to receive transactional messages from ATTA: receipts, visit confirmations, billing notices, and important information about your membership or the Facility. These are part of the service and cannot be unsubscribed from while your account is active.
Newsletters and promotional email are separate and optional. You choose whether to receive them, and every one includes an unsubscribe link. You can change your preference at any time from your account.
12. Privacy & Your Data
ATTA collects the information you give us (name, email address, phone number, and emergency contact) and records of your membership, purchases, and visits, in order to run the club. We use service providers to do this and share with each of them only what it needs to provide its service. Our Privacy Policy lists every provider we use, explains how long records are kept, and sets out your choices, including how to request a copy of your information, correct it, or ask us to delete your account.
Two things about the club are visible to other people, and both are yours to control. The player directory on this site is public, and you are not in it unless you switch it on in your account; it is off by default. Whether you receive newsletters is likewise your choice. Neither affects your membership.
We do not sell your personal information. We may disclose information where required by law or to protect the safety of members and staff. Some records must be retained for legal, accounting, or safety reasons, including records of a liability waiver you accepted.
13. Suspension & Termination
By you
You may end your membership at any time as described in Section 5. Cancellation stops future renewals, and your access continues to the end of the period you have paid for. Within the five-day window, you receive the refund described in that section instead.
By ATTA, for cause
ATTA may suspend or terminate your membership and Platform access, with or without advance notice, for breach of these Terms, for conduct that endangers or harasses others, for non-payment, or where required by law. If ATTA terminates for cause, your right to access the Facility ceases immediately and no refund is owed.
By ATTA, without cause
ATTA may also terminate this Agreement for any reason on 30 days' written notice. If it does, ATTA will refund the unused portion of any period you have already paid for, calculated pro rata.
Sections that by their nature should survive termination survive it. Those include Section 9 (waiver), Section 15 (disputes), and Section 16 (general).
14. Changes to These Terms
ATTA may update these Terms from time to time. The current version and its effective date always appear at the top of this page.
For material changes, we will give notice before they take effect, by email to the address on your account, by notice in the Platform, or by posting at the Facility, and we will ask you to accept the updated version. The updated version governs from the date you accept it. For changes that are not material, such as clarifications and corrections, continuing to use the Facility or the Platform after the change takes effect is acceptance.
If you do not accept an updated version, you may cancel your membership as described in Section 5, and the version you last accepted governs until your cancellation takes effect.
15. Dispute Resolution
Please contact us first. Most disputes are resolved with a conversation.
Any dispute arising under or in connection with this Agreement that cannot be resolved informally shall be brought in the state or federal courts located in Honolulu, Hawaii, and each party consents to the jurisdiction and venue of those courts. Either party may instead bring an eligible claim in small claims court in Honolulu.
To the extent permitted by law, disputes will be resolved individually, and not as a class, consolidated, or representative action.
16. General
Governing law. This Agreement is governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict-of-laws rules.
Notices. Written notice under this Agreement may be given by email: to you, at the email address on your account, and to ATTA, at contact@alohatabletennis.org. Notice by email is effective when sent.
Entire agreement. This Agreement, together with the policies it references, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, and agreements, whether written or oral, including any earlier paper membership agreement.
Severability. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions stay in full force.
No waiver.ATTA's failure to enforce a provision is not a waiver of its right to do so later.
Assignment. You may not assign this Agreement. ATTA may assign it in connection with a merger, reorganization, or transfer of its operations.
